David L. Martin is a senior partner in the law firm of Lee Smart, P.S., Inc. Mr. Martin has his undergraduate degree from Washington State University, his law degree from the University of Washington Law School, and an advanced degree in law from George Washington University Law School. Mr. Martin concentrates his practice in the defense of tort claims, with emphasis on professional liability, including medical malpractice and legal malpractice defense, as well as product liability claims. Mr. Martin has been in practice for 32 years, has received an "AV" rating for lawyers from Martindale-Hubbell, has been listed in the publication Best Lawyers in America since its inception. He lectures before professional and civic groups on topics relating to his areas of practice. Mr. Martin is a member of the Seattle-King County Bar Association, Washington State Bar Association, Washington Defense Trial Lawyers, and the Defense Research Institute.


Representative Cases

Mr. Martin has defended medical malpractice litigation including claims involving birth injury to infants, radiation injury claims including damage to eyes and brain damage, anesthesia claims involving death, permanent comatose state, and other injuries, psychiatric claims involving suicides, sexual abuse of patients, and misdiagnosis of multiple personality disorder, plastic surgery cases, infectious disease issues, cardiac care cases, and other areas of medicine.

Legal Malpractice Cases:

Legal malpractice cases include the defense of lawyers in cases involving probate issues, dissolution proceedings, plaintiff personal injury lawyers, wrongful death claims against lawyers, and a variety of other cases. Other professional liability cases include the defense of insurance brokers, real estate brokers, and accountants.

Product Liability Cases:

Product liability cases include the defense of medical device manufacturers, defense of a brewery in fetal alcohol syndrome litigation, defense of food related claims involving E.coli infection cases, defense of a major asbestos manufacturer, gas explosion claims, firearms claims, stoves, electric baseboard heaters, televisions, chainsaws, hydraulic devices, conveyor belts, and other products.

Defense of a university in cases involving quadriplegia as a result of a fall on a hiking trip sponsored by the university, reverse discrimination lawsuits by a white male applicant to the medical school, defense of physicians-assistant training programs in claims of arbitrary and capricious conduct, defamation claims against a student newspaper and staffers, claims brought by students alleging inadequate security resulting in sexual assault, a claim brought by a student athlete alleging improper conduct by a coach, and medical malpractice related issues.
