Janine E. Leary is a shareholder at Lee Smart. Her practice emphasizes civil defense litigation, including medical malpractice and long-term care malpractice. Ms. Leary graduated cum laude from Ohio University in 1997 with a Bachelor of Arts degree in History. Ms. Leary then obtained her J.D. degree from Gonzaga University School of Law in May 2000, where she graduated fourth in her class. Janine handles all aspects of litigation including case analysis and strategy, arbitration, depositions, mediation, motions, trial and appellate work. She has been selected as a “Rising Star” lawyer in Washington by Washington Law & Politics magazine. Ms. Leary is admitted to practice in all Washington state courts as well as the United States District Court for the Western District of Washington. Ms. Leary is a member of the Washington State Bar Association and the King County Bar Association.

Representative Cases

  • Ellis v. Connell – Second-chaired two-week medical malpractice trial. Plaintiff alleged medical negligence in placement of an IUD, and failure to diagnose subsequent infection. Defense verdict rendered in less than two hours.
  • Williams v. Jones - Summary judgment dismissal of all claims, affirmed by Court of Appeals. Allegations included legal malpractice for failing to timely file medical malpractice claim.
  • Robinson v. ChristiansenSummary Judgment Dismissal of all claims. Case included allegations of wrongful death and negligence stemming from the treatment of plaintiff for chronic pain.
  • Stoner v. Moorhead – Summary Judgment dismissal of all claims involving allegations of medical negligence following surgery for thoracic outlet syndrome.
  • Fritchman v. Realica Voluntary dismissal by plaintiff in case alleging violations of the standard of care in the placement of breast implants and failure to obtain informed consent.
  • Soundcare v. DalinVoluntary dismissal by plaintiff in case alleging negligence and violation of Washington 's Vulnerable Adult Statute. Plaintiff agreed to dismiss case following filing of Motion for Summary Judgment.
  • Schulze v. Redwood – Voluntary dismissal of case involving allegations of medical negligence following surgery for bladder suspension surgery.
