Michelle A. Corsi is a shareholder who joined Lee Smart, P.S., Inc. in 1995 after having served as a judicial law clerk in Snohomish County Superior Court. Michelle's practice emphasizes civil defense litigation in the areas of professional liability, including real estate and legal malpractice matters, employment discrimination, personal injury, and product liability including asbestos. Michelle is a member of the Washington State Bar Association, the Washington Defense Trial Lawyers and the King County Bar Association since 1995. She is admitted to practice in the U.S. District Court, Western and Eastern Districts of Washington and the Ninth Circuit Court of Appeals. Michelle has been selected as a “Rising Star” lawyer in Washington by Washington Law & Politics magazine. In 2005 the Martindale-Hubbell Law Directory gave Ms. Corsi its "AV" Preeminent rating, which is its highest. Michelle is also included in the Seattle Met Magazine's 2010 and 2011 Top Lawyers List. In 2011, Michelle was named one of Washington's Super Lawyers by Super Lawyers Magazine.

Ms. Corsi graduated cum laude from Washington State University with a Bachelor's degree in English in 1991 and was selected as a member of Phi Beta Kappa. Michelle received her J.D. from Willamette University College of Law in 1994.

Representative Cases

  • Berschauer Phillips Construction v. Concrete Science Services. - Division I upheld a King County Superior Court decision in favor of Concrete Science’s former attorneys quashing a writ of execution obtained by Berschauer Phillips on an alleged legal malpractice claim.  Also obtained dismissal in a second lawsuit filed by Berschauer Phillips in Thurston County against Concrete Science’s former attorneys.  Division II granted discretionary review after the trial court stayed Berschauer’s action rather than dismissing for lack of standing.  After the Division I decision affirming the order quashing the writ of execution was rendered, Berschauer agreed to dismiss its second lawsuit.
  • Moltz v. Re/Max - Real estate malpractice case in Snohomish County Superior Court.  Defense verdict in arbitration.
  • Nielsen v. Solid Trading v. Sun Mark Realty – Real estate malpractice claim in Whatcom County Superior Court. Defense verdict. Affirmed on appeal. Attorney's fees and costs awarded at trial and on appeal.
    Linder v. Beadex Manufacturing Company – Defense of asbestos manufacturer in mesothelioma cancer case brought by plaintiff against various asbestos containing products and manufacturers. Trial proceeded against sole remaining defendant, with jury returning a verdict of less than prior payments and set-offs, resulting in a defense verdict.
  • Homer v. Continental Baking Company – Second chaired this trial where plaintiff asserted claims of employment discrimination for wrongful discharge and breach of contract. Jury rendered a defense verdict.
  • Brown v. Wotipka – Legal malpractice case. Dismissed with prejudiced upon motion for failure to provide discovery.
  • Amini v. Elahi – Prevailed in a fee dispute for attorney client in an arbitration before the Washington State Bar Association.
  • Transhaw v. Interstate Woods – Automobile accident, soft tissue injury case. Defense verdict in arbitration.
  • Simpson v. Port Townsend School District – Defended school district in suit by teacher regarding First Amendment claims. Defense verdict at trial affirmed on appeal.
  • Gerard v. Shattuck - Legal malpractice case involving a boundary line property dispute. Case dismissed upon summary judgment. Plaintiff appealed. The dismissal was affirmed on appeal. Attorney's fees and costs awarded on appeal for having to respond to a frivolous appeal.
  • Losh v. Kertsman, et al. - a breach of contract action stemming from a commercial lease, representing the plaintiff.  The trial court granted our client’s motion for summary judgment, finding all defendants jointly and severally liable for the breach.  The trial court also awarded attorney fees and costs to Losh, pursuant to the terms of the lease agreement.  Affirmed on appeal, including an award of costs.  155 Wn. App. 458, 228 P.3d 793 (2010), 2010 Wash. App. LEXIS 735.

  • Cook v. Apple Park Apartments - Summary judgment granted in a personal injury lawsuit brought by a tenant against her landlord for mold exposure
  • Alexander & Associates v. Keller Williams - Breach of contract again against broker stemming from a Confidentiality Agreement required by a listing for the showing of commercial property. Summary judgment granted and attorney's fees and costs awarded.
  • Hansen v. Anderson Hunter – Legal malpractice case. Attorney's fees and costs awarded.
  • McKay v. Wells Fargo - Legal malpractice case in Federal Court. Dismissal affirmed by U.S. Court of Appeals, 9th Circuit.
  • LaWall v. Home Realty - Real estate malpractice suit.
  • Colberg v. Windermere - Real estate malpractice suit.
  • Elhard v. Crane v. NW Brokers – Real estate malpractice suit. Attorney's fees awarded.
  • Ferling v. Century 21 - Real estate malpractice suit.
  • Summers v. Chelan Realty – Real estate malpractice case.
  • Garkavi v. West - Rear-end soft tissue injury case.
  • Avery v. Twin Forest Community – Slip and fall case.
  • Peterson v. Richardson – Slip and fall case. Defense of homeowner in a claim made by contractor.
  • Fuentes v. Continental Casualty Company – Insurance coverage case.
  • Edmonds Associates v. Johnson's Pharmacy – Landlord/tenant lease dispute.
  • Walstad v. Lindsey – Defamation/outrage case.
  • Konsker v. ARCO – Race discrimination case.
  • Hallet v. Battery Power Systems – Employment discrimination claims for retaliation and wrongful discharge.
  • Dandridge v. Ray – Legal malpractice. Judgment of attorney's fees and costs based upon CR 11 and the frivolous action statute.
