Jeffrey P. Downer and Dylan J. Johnson successfully sought dismissal of claims alleged against a homeowners association in Ma v. Homeowners’ Association in King County Superior Court. Plaintiff, a member of the Association, sued the Association for damages arising out of water damage to plaintiff’s condominium. Plaintiff claimed the Association had a duty to reimburse plaintiff for an excessive vendor invoice, and for improvements made to the unit. Plaintiff’s claims were dismissed on a Rule 12(b)(6) motion to dismiss.
