PERSONAL INJURY ACTION DISMISSED

In Chrisman v. Precision Forestry, a multi-million-dollar personal injury action, Jeffrey P. Downer and Sydney J. Martinez, won a motion for summary judgment in Snohomish County Superior Court. Plaintiffs sued a logging company, Jeff and Sydney’s client, as well as several others for negligence, gross negligence, nuisance, corporate negligence, and strict liability. Plaintiffs’ claims arose when gusty winds blew down a tree located within a Riparian Management Zone (RMZ). Jeff and Sydney successfully argued that Plaintiffs’ claims are barred by immunity under RCW 76.09.330, as the tree that fell was located within the designated RMZ. The court granted the motion for summary judgment with prejudice.
