Counterclaims Breach of Fiduciary Duty

In Vaughn v. Cohen, et al., 3:23-CV-06142-TMC, 2025 WL 918781 (W.D. Wash. Mar. 26, 2025), Tim Rosewell and Marc Rosenberg obtained summary judgment dismissal of breach of fiduciary duty counterclaims against an attorney/personal representative (PR) of an estate. The attorney/PR brought a lawsuit against the beneficiary of a will on behalf of an estate. The beneficiary alleged counterclaims for breach of fiduciary duty, which Tim and Marc defended. Tim and Marc convinced the Judge that the attorney/PR acted according to the orders of the probate court judge and her actions were not unreasonable.
