Daniel C. Mooney and Susan Kim obtained a favorable summary judgment result on behalf of their property developer client in Faust v. Property Developer. Plaintiff alleged claims for breach of contract, fraud, negligent misrepresentation, violation of the Consumer Protection Act, breach of implied duty, breach of implied warranty, trespass, and sought to pierce the corporate veil. Plaintiff sought damages in excess of six-figures. After extensive discovery and failed attempts to negotiate a resolution, Dan and Susan moved for summary judgment, which the court granted, fully dismissing all of plaintiff’s claims. Dan and Susan then obtained a judgment against plaintiff for the full amount of their attorney fees and costs incurred in defending the action.
